Agreement to Terms

By accessing or using MakeAIHQ's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Description of Services

MakeAIHQ provides a platform for businesses to create, deploy, and manage ChatGPT Apps. Our services include:

• ChatGPT App development tools and templates
• Managed hosting infrastructure
• Compliance and submission assistance
• Analytics and reporting
• Customer support

Account Registration

To use our services, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

Subscription and Payments

Billing

• Subscriptions are billed monthly or annually in advance
• Prices are in US dollars unless otherwise stated
• All fees are non-refundable except as stated in our refund policy
• We may change prices with 30 days notice

Refund Policy

We offer a 30-day money-back guarantee for new subscribers. After 30 days, refunds are provided at our discretion.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You retain access to services until then.

Acceptable Use

You agree not to use our services to:

• Violate any laws or regulations
• Infringe intellectual property rights
• Transmit malware or harmful code
• Engage in fraudulent activities
• Harass, abuse, or harm others
• Violate OpenAI's usage policies
• Collect user data without consent
• Resell or redistribute our services without authorization

Intellectual Property

Our Property

MakeAIHQ and its licensors own all rights to the platform, templates, documentation, and branding. You may not copy, modify, or distribute our intellectual property without permission.

Your Content

You retain ownership of content you create using our platform. By using our services, you grant us a license to host, display, and transmit your content as necessary to provide our services.

ChatGPT Apps

ChatGPT Apps created using our platform are subject to OpenAI's terms and conditions. We are not responsible for OpenAI's approval or rejection decisions.

Service Level Agreement

We strive to maintain 99.9% uptime for Starter plans and 99.99% for Professional and Enterprise plans. Scheduled maintenance windows are excluded. Credits for downtime may be provided at our discretion.

Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to our data practices.

ChatGPT App SDK Compliance

All ChatGPT Apps created using MakeAIHQ must comply with OpenAI's Apps SDK requirements and ChatGPT App Store policies:

• Apps must follow OpenAI's Usage Policies
• Apps must pass OpenAI's approval process before submission to ChatGPT App Store
• Apps must comply with OpenAI's technical requirements (MCP protocol, widget runtime, authentication flows)
• Apps must not violate OpenAI's UI/UX guidelines (system fonts only, max 2 CTAs per card, no nested scrolling)
• Apps must implement proper security measures (no API keys in client-side code, proper OAuth 2.1 with PKCE)
• Apps must respect user privacy and data protection requirements

OpenAI Approval and Rejection

MakeAIHQ provides tools and guidance to help you create compliant ChatGPT Apps, but we cannot guarantee OpenAI approval. You acknowledge that:

• OpenAI has sole discretion over ChatGPT App Store approvals and rejections
• MakeAIHQ is not responsible for OpenAI's approval decisions
• OpenAI may change their requirements, policies, or guidelines at any time
• Apps previously approved may be removed if they later violate OpenAI's policies

Your Responsibilities

When creating ChatGPT Apps using our platform, you are responsible for:

• Ensuring your app complies with all OpenAI policies and requirements
• Obtaining necessary licenses, permissions, and consents for your app's functionality
• Maintaining your app's compliance after deployment
• Responding to user reports and OpenAI compliance requests
• Updating your app when OpenAI changes their requirements

Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee:

• Uninterrupted or error-free service
• Approval by OpenAI's ChatGPT App Store
• Specific results or revenue
• Compatibility with all systems

Limitation of Liability

To the maximum extent permitted by law, MakeAIHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless MakeAIHQ and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these terms.

Termination

We may suspend or terminate your access to our services at any time for:

• Violation of these terms
• Non-payment
• Fraudulent activity
• At our sole discretion with 30 days notice

Upon termination, your right to use the services ceases immediately. We may delete your data after 90 days.

Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. You waive the right to participate in class actions.

Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or platform notification. Continued use after changes constitutes acceptance.

Severability

If any provision of these terms is found unenforceable, the remaining provisions remain in effect.
